Congress
leader Rahul Gandhi was granted bail and was suspended the sentenced of two years by
a session court in Gujarat's Surat on Monday.
According
to reports, the Congress leader was granted bail after he lodged an appeal in
the court against his conviction in the defamation case of 2019 and suspension
of the 2 year sentence.
However,
the session court declined his appeal to stay the conviction.
According
to an advocate Rohan Panwala, Rahul Gandhi's application for the stay of
conviction is posted for hearing on April 13 while Gandhi's lawyers informed
that he need not attend court proceedings on April 13.
Reportedly
the court has issued a notice to the complainant, BJP MLA Purnesh Modi on Rahul
Gandhi's plea for a stay on his conviction and has been asked the complainant
to file a reply by April 10.
The
hearing on appeal against the conviction to be held on May 3.
Right
after the court order, the Congress leader took to his Twitter and wrote,
"This is a fight to save democracy, against 'Mitrakal'. In this struggle,
truth is my weapon, and truth is my support."
If Rahul
Gandhi's judgement is upheld, he will no longer be eligible to serve as a
member of parliament and will be prohibited from running in elections for eight
years.
Defamation
case- Gandhi was earlier sentenced to two years in prison in a criminal
defamation case over his Modi surname remark in a rally in Karnataka's Kolar
back in 2019.
In the
rally, which was ahead of the 2019 Lok Sabha polls, Gandhi said, "How come
all thieves have Modi as the common surname."
The case
was filed against the former Congress Chief by Purnesh Modi, BJP MLA and former
Gujarat minister.
